What these T&Cs cover

These standard terms and conditions (“T&Cs”) apply to all ebook purchases from Compassiviste Foundation’s online shop and exclude virtual gifts as these are classed as donations and described in this way on our website. Our T&Cs for donations can be found at the foot of this page.

Please read this page carefully before making a purchase. We’ve tried our best to make these T&Cs as easy to understand as possible, but if any part of them is unclear, or if you think they contain a mistake, then please let us know before you make a purchase.

Who ‘We’ are

Who ‘You’ are

By contracting with Compassiviste Foundation, you are warranting that you are at least 18 years old. Unfortunately, we cannot sell products on our website to those under the age of 18 as minors are legally incapable of entering into binding contracts.

Nobody else has any rights under this contract. This contract is between you and us. No other person will have any rights to enforce any of its terms.

How to make a purchase & amending your order

Our online shop will guide you through the process of making an ebook order. Please take the time to check your order before placing it.

The price of an ebook will be displayed on the shop page and the total cost of your purchase shown in your cart at checkout. We take all reasonable care to ensure that the price of the product advised to you is correct. If you or we discover an error in the price of the product you order, please contact us immediately or within seven days of making the purchase.

We accept payment by Mastercard and Visa debit and credit cards registered to a valid UK address, and by Paypal.

By placing an order with us you are making an offer to us to purchase one or more products; this offer is accepted by us when we deliver the product. Any product(s) which have not been ordered or delivered do not form part of this agreement. When you place an online order to purchase a product, you will receive an email from us confirming your order.

Availability & Description of Goods

Compassiviste Foundation take all reasonable care to ensure that the products it sells are available. However, the supply of goods from this website is subject to availability and it may not always be possible for us to notify customers otherwise in advance of a purchase. In such cases, a refund will be given or an alternative proposed.

We also take all reasonable care to ensure that the descriptions of the products we sell are accurate and up to date. In rare cases where we get this wrong, we reserve the right to refuse orders. In such cases we will notify you and, if payment has already been made, refund you for the full amount.

How we contact you

We will confirm receipt of your order by email and may also contact you by telephone if you have provided us with your telephone number. How we manage and store your contact details and personal data can be found in our Privacy Policy. Our privacy policy describes what we will do with your personal information. Please take the time to read it carefully. You will be asked to agree to our privacy policy when you create an account with us or when you place an order with us.

Digital content compatibility and replacements

Compatibility of digital content. Some digital content is subject to compatibility restrictions. We will always make those compatibility restrictions clear to you before you pay for the digital content.

The Consumer Rights Act 2015 says that goods must be as described, fit for purpose, and of satisfactory quality. If the digital content you buy from us is faulty you are entitled to a replacement throughout the duration of its stated lifespan. If a replacement cannot be given or is otherwise not accepted by you, you will be entitled to a refund. If the fault damages your device and we haven’t used reasonable care and skill, you may also be entitled to compensation. Further information about refunds can be found below.

Digital content – copyright and business use

By purchasing digital content from us, you are warranting that you will not make digital or print copies of it, unless the law allows you to do so, without our prior consent. If you are found to have breached this clause, we reserve the right to refuse future orders from you.

We only supply the products for domestic and private use. If you use our products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Delivery of goods

We will make the product(s) you buy from us available immediately after we accept your order. This may affect your statutory right to a refund under the Consumer Contracts Regulations 2013.

We cannot, however, be responsible for delays outside of our control and if this occurs we will notify you as soon as possible and take all reasonable steps to reduce the delay. Such delays may be caused, for instance, by technical problems or because you have asked us to amend your order. If we cannot reasonably minimise a delay then we will notify you and offer you a refund for any product you have purchased but not downloaded.

Terminating the contract

You can terminate your contract with us if what you have purchased from our website is faulty or misdescribed; because of likely delays in its delivery; or because you have simply changed your mind about the purchase.

If you are ending the contract because an ebook you receive is faulty or misdescribed, or because a likely delay in delivery is not agreeable, we will refund you in full for the cost of your purchase.

If you have changed your mind about the purchase, you are entitled to a full refund under the Consumer Contracts Regulations 2013. You have 14 days after the day your order is accepted to cancel your order. However, you will not be entitled to a refund if you have started to or have otherwise fully downloaded your product.

Please provide your full name, details of the order and your email address. If you call us, we may ask for this information for security purposes.

How refunds work

When a refund becomes due, we will refund to you the full price you paid us by the method you used for payment – for example, on the credit card you used to make the purchase. We will make the refund within 14 days of becoming aware that a refund is due.

Losses

We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

Other important terms

Changes to these terms: We reserve the right to make changes to our T&Cs at any time. You will be subject to the T&Cs in force at the time that you make a purchase.

Jurisdiction: These T&Cs are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts. If a court finds that part of this contract unlawful, the rest will continue in force.

Transfer of agreement: We may transfer our rights and obligations under these T&Cs to another organisation. If this happens, we will notify you and ensure that the transfer does not affect your contractual rights.

Complaints

If you are not happy about the way we have handled your complaint, you have the right to submit the dispute for online resolution to the European Commission Online Dispute Resolution Platform, which you can find at http://ec.europa.eu/consumers/odr

Donations – Our Terms and Conditions

These T&Cs govern the relationship between you (“the donor”) and Compassiviste Foundation (“us”, “we”). By confirming on the website that you wish to make a donation to Compassiviste Foundation you agree to be bound by these terms and conditions for that donation.

This contract is between you and us and governed by English law. No other person shall have any rights to enforce any of its terms.

All personal information that you provide to us from time to time will be collected, managed and processed in accordance with our Privacy Policy.

The Donation

If you donate a virtual gift through our online shop or donate on our website to one of our specific causes or appeals, we will always endeavour to use that kind donation for that particular purpose. However, the way that we make use of your donation will remain at our discretion but always within our stated charitable objectives.

All donations made to us through our website are to be made via our payment services providers, Paypal and Stripe. By confirming that you wish to proceed with your donation you authorise Paypal or Stripe (or such other payment services provider as we may use from time to time) to request funds from your credit or debit card provider.

We will send you prompt acknowledgement by email confirming receipt of your donation. If you do not receive such an email from us please do let us know as soon as possible by contacting us.

Cancelling Ongoing Donations

If you wish to cancel an ongoing donation to us, you can do so at any time. We only accept ongoing or reoccurring donations using Paypal, so to cancel it you will need to log in to your Paypal account and follow the instructions.
